Terms of Service

1. Definitions

• "Agreement" — The Terms of Use, the Privacy Policy, Cancellation and Refund Policy, Pricing Policy, and any other policies framed by us from time to time.
• "Fameclix", "we", "our", "us", "Company" — BeeX Media Pvt. Ltd. having its registered office at A-88, Sector-4, Noida, Uttar Pradesh, India – 201301.
• "Platform" — Services provided through fameclix.com or through the application installed on your device.
• "Services" — Including but not limited to:

  For Influencers:

  1. Apply to briefs posted by brands/agencies and negotiate pricing.
  2. Get approvals on campaign creatives.
  3. One-on-one conversation with the brand/agency.
  4. Online creative repository and campaign analytics.

  For Brands:

  1. Search for influencers by parameters and create lists.
  2. View complete influencer insights.
  3. Create and post campaign briefs and receive proposals.
  4. Complete workflow for price negotiation, creative approvals, and reporting.

  For Agencies:

  1. All brand services plus the ability to add multiple brands to the dashboard.
• "Website" — fameclix.com
• "You", "Your", "User" — The end user who meets the eligibility criteria set out below.

2. Right to Use

Your right to use the Services is subject to limitations, conditions, and restrictions established by us at our sole discretion. We may alter, suspend, or discontinue the Services at any time without prior notice and may impose limits on certain features or restrict your access without liability on our part.

3. Availability of Services

While we take every reasonable action to keep the Services functional and up to date, interruptions do happen — including for routine maintenance. You understand that Services could be interrupted, suspended, or terminated without fault on our part, and we shall not be held liable for any loss arising therefrom.

4. Account and Plan

To register an account, fill the online form on the Platform accurately and honestly. After registration, select a plan as per our Pricing Policy. Every form undergoes review — we reserve the right to reject, suspend, or delete profiles that do not meet our standards, or if information provided is found untrue, inaccurate, or incomplete, without any refund of plan fees.

You are responsible for keeping your account details current and your password confidential. You shall be responsible for all activities under your account. You may not sell or transfer your account to any other person or entity.

You shall not display or post any grossly harmful, obscene, pornographic, pedophilic, hateful, racially objectionable, fraudulent, or unlawful content through your account. We reserve the right to deny, restrict, or suspend your access for any violation.

Account Deletion: To delete your account, email info@fameclix.com. We will delete your account within 10 business days and send a confirmation email. Plan fees are non-refundable upon account deletion. All data associated with the deleted account will be permanently removed.

5. Intellectual Property Rights

BeeX Media Pvt. Ltd. solely owns rights in the name and mark of Fameclix and the logo on the Platform. You are not permitted to use these marks in any manner without our express written permission.

We own all intellectual property rights in and to the Platform, including all content hosted, published, displayed, or uploaded by us. No information, content or material from us may be copied, reproduced, republished, or distributed in any way without our express written permission.

6. Dispute Resolution

For any dispute, please contact us at info@fameclix.com. These Terms, along with the Privacy Policy, Pricing Policy, and Cancellation and Refund Policy, shall be governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts of India.

We shall not be held liable for any dispute arising from communications between two users on the Platform.

7. Liability

The content on the Platform is provided in good faith on an "as is" basis without any warranty as to fitness for purpose. We do not accept liability for errors, omissions, or any damages arising from your use of the Platform or third-party sites linked therefrom. Any material downloaded through the Platform is at your own risk.

Nothing in this Agreement limits or excludes our liability for fraudulent misrepresentation, death or personal injury resulting from our negligence, or any other liability that cannot be limited or excluded by law.

8. Breach of These Terms

Your account and associated plans are non-transferrable and may not be sold, traded, combined, or shared with any other person. We may terminate your account at our sole discretion, with or without notice, for any violation of these Terms. Upon termination, all information and compilations created by you through the Platform may be removed.

9. Indemnification

You agree to indemnify and hold us, our directors, representatives, employees and contractors harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Platform, your breach of these Terms, or your infringement of any intellectual property or other right of any person or entity.

10. User Warranties

By creating an account, you warrant that you: (a) possess the authority to form a binding legal obligation; (b) all information provided is about yourself only and is accurate, true, up-to-date and complete; (c) your use of the Service will always comply with these Terms; and (d) you shall safeguard your username and password and are responsible for all use of your account.

11. Disclaimer of Warranties

Your use of the Service is at your sole and exclusive risk. The Services are provided on an "as is, with all faults" and "as available" basis, without warranties of any kind — including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Service will meet your requirements, or will be uninterrupted, timely, secure, or error-free.

12. General

If any provision of these Terms is unenforceable under applicable law, that provision shall be struck out. All remaining provisions shall remain in full force and effect. Our failure to act on any breach does not waive our right to act in relation to subsequent or similar breaches.

13. Miscellaneous

These Terms of Use, Privacy Policy, Cancellation and Refund Policy, and Pricing Policy constitute the sole and entire agreement between you and us with respect to the Service and supersede all prior understandings, representations, and warranties.

14. Terms and Conditions for Influencers

• We connect brands with influencers registered on our Platform in lieu of rendering the Services.
• Influencers must have attained 18 years of age to register and render Services.
• Influencer shall ensure that any post or action on social media for any brand is for promotional purposes and does not result in negative publicity.
• Influencers must provide accurate information about all social media handles and traffic. Misrepresentation results in a breach.
• Fameclix shall not be held responsible for communications between the brand and influencer. Influencers shall not associate with any brand outside the Fameclix environment; doing so grants Fameclix the right to permanently revoke the account.
• Influencers shall not engage directly in remuneration processes with a brand outside the Platform.
• Any data manipulation (manual or through bots) will void agreements and forfeit any payments due.

15. Terms and Conditions for Brands

• Brands shall provide accurate information about products and services to influencers prior to engagement.
• Brands undertake to make payments to us as per the Pricing Policy before executing any campaign.
• Fameclix shall not be held responsible for communications between the brand and influencer. Brands shall not associate with any influencer outside the Fameclix environment; doing so grants Fameclix the right to permanently revoke the brand's account.
• We shall act as a facilitator between the brand and influencer. We are not responsible for any post or Service that has negatively affected the brand image when it was approved by the brand or its representatives.
• All applicable taxes with respect to the Services shall be paid by the brand.

16. Meta Platform API Usage

Fameclix integrates with Meta's Platform APIs — including the Instagram Graph API, Facebook Pages API, Messenger Platform API, and oEmbed API — to enable features for brands and influencers. By connecting your Meta account(s), you agree to the following terms in addition to Meta's own Terms of Service and Platform Policies.

• Facebook Pages: You authorize Fameclix to access your Facebook Page(s) to publish content and videos, moderate posts and comments, and retrieve Page insights. You remain solely responsible for all content published to your Page through Fameclix.
• Instagram: You authorize Fameclix to access your connected Instagram Business or Creator account to publish posts, reels, and stories; manage and respond to comments; and send automated Direct Messages based on keyword triggers you configure. You are responsible for ensuring all published content and automated messages comply with Instagram's Community Guidelines.
• oEmbed: Fameclix may embed publicly available Facebook, Instagram, and Threads content for campaign preview and reporting. Only publicly accessible content is used.
• Messenger: You authorize Fameclix to access messages sent to your business Facebook Page via Messenger and to send responses on your behalf. You agree not to use this integration to send unsolicited messages or spam.
• Authorization and Revocation: You may revoke Fameclix's authorization at any time via Facebook Settings > Security and Login > Apps and Websites, or through your Instagram account settings. Revoking access will disable the corresponding features on Fameclix.
• Compliance: Your use of Meta-connected features must comply with Meta's Terms of Service, Platform Policies, and Community Standards at all times.
• No Warranty on Meta Services: Fameclix's Meta integrations depend on Meta's APIs. We do not guarantee uninterrupted availability and shall not be liable for disruptions caused by changes to Meta's APIs or policies.
